 Anyone who is involved in a motor vehicle accident is entitled to bring a lawsuit against an at-fault driver. In the case of minors or incompetents, the lawsuit must be brought through a guardian appointed by the court, generally a parent of the injured minor. One does not have to be a citizen of California or even the United States to be entitled to bring a lawsuit for personal injuries when there is a driver at fault.
